These Terms and Conditions are important and you should read them carefully before deciding to purchase. Your use of and access to the Site and purchase of goods and services via this Site is conditional upon your acceptance of and compliance with these Terms and Conditions, notices and disclaimers contained in this document and elsewhere on the Site, and on you complying with all applicable laws of the Commonwealth of Australia (including its states and territories).

Definitions in this User Agreement:

"Little Black Box "We", "Our", or "Us" means Little Black Box (ABN 444 358 695 65).
"User", "You" or "Your" means an individual who visits or uses the website.
"Site", "Its" or "It" means the website maintained and operated by Little Black Box and available at www.littleblackbox.com.au

User Contributed Content
Throughout the use of the site along with social media platforms managed by Little Black Box users may be invited to review or comment on various products. If you do submit such reviews, this automatically gives Little Black Box permission to use, reproduce, modify and publish them in a royalty-free, irrevocable manner. You also permit Little Black Box to publish your first name, last name and residential state or town, age and profession.
Such reviews posted, in no way represent the views or opinions of Little Black Box or its owner, employees, subcontractors or others, but are the sole product of its creator.

Site Use Restrictions
Little Black Box requires all users to agree not to use the site, and specifically prohibit any use of the Site, for any of the following purposes:

1. Posting, communicating or transmitting any material that infringes on any intellectual property, publicity or privacy right of another person or entity;
2. Posting any information which is untrue, inaccurate or not Your own;
3. Engaging in conduct that would constitute a criminal offense or give rise to civil liability or otherwise violate any law or regulation;
4. Attempting to interfere in any way with any security protections of of the Site or Little Black Box’s network, or attempting to use the Site’s service to gain unauthorised access to any other computer system.

Payments, Purchasing & Pricing
In addition to the terms that relate to your use of the Site, the following terms relate to your purchase of a Little Black Box.
When you place your order to purchase a box, the terms with respect to ordering and delivery are governed by these terms.
When you purchase a “Little Black Box”, the price will cover the cost of your “Little Black Box” and delivery costs within Australia.
Note that this excludes multiple deliveries of the same box and any costs related to returns or exchanges should goods not be damaged.
All orders placed on this Site are quoted and charged in Australian dollars and, unless we state otherwise, all prices are inclusive of GST. Our pricing is set out on www.littleblackbox.com.au and we may update this at our discretion. Please note that we do not provide price protection nor refunds in the event of a price change or promotional offering.
Payments shall be processed through our site and shall be in the form you select when you purchase our box.
You must not pay, or attempt to pay, for a box or multiple boxes through any fraudulent or unlawful means.
Little Black Box will not be liable for any charges you incur as a result of out of date payment information. If we incur an expense due to the incorrect payment information that you provided, we reserve the right to seek reimbursement for such expense.
We may offer promotional discounts from time to time. You must agree to the terms of the promotion in order to receive the discount. All promotional discounts are non-refundable.

Purchasing
By purchasing a Little Black Box you are agreeing to pay a single payment. Our payment schedule consists of an upfront payment as agreed to by you. By entering into this Agreement, you acknowledge that your purchase has a single payment feature and you accept responsibility for any additional charges be it re-delivery fee if applicable.

We reserve the right at our absolute discretion not to allow any purchases at any time without giving any reasons for our decision. We also have the right to refuse to follow through with a purchase once it has been made at any time without giving any reasons for our decision. In this instance you would be refunded for any purchase where part or all goods have not been received.

Cancellation
You are not able to cancel a purchase once it has been made. You can however change the address that it goes to by sending a written request to us. Your request must be received a minimum of 5 days prior to your LBB’s scheduled dispatch date otherwise your request will not be accepted.

Delivery
Purchases from or via the site or affiliate sites are transported and delivered to you by an independent carrier not affiliated with, or controlled by, Little Black Box. Any risk associated with the delivery of the products passes to you when Little Black Box or our supplier delivers these items to the carrier.

We accept no responsibility for goods lost in transit or goods lost, stolen or damaged after delivery. Any decision to replace goods received in such circumstances will be made by us, on a case-by-case basis, in exercise of our sole discretion. See FAQ’s for more on this.

You understand and agree that you shall receive no exchanges for any goods or services once we or our supplier delivers these items to the carrier unless the goods received by you are damaged or requiring a size exchange only. You also understand that “Little Black Box” are not responsible for incorrect delivery details provided by you. We reserve the right to charge an administration fee and additional delivery charges for delivery of your Little Black Box purchase where it is returned to us for this reason. Additional you understand that “Little Black Box” have a strict no refunds policy.

Replacements and Exchange
All goods are checked for quality before dispatch and while we try our best to ensure that the goods are delivered to you in perfect condition, the goods may be damaged in transit. Where you receive a faulty or damaged item from us, we can send a replacement item to you provided that you:

1. Fill out a Damaged Goods Form (DGF) within the first 5 days of receiving the product
2. Send clear photographs of the box EXACTLY as it was when you first opened it or upload the photo and include it in the section where it is requested in the form.
3. Please include Your contact details and the reason for the replacement.

In the case where stock of the item is unavailable, we will offer you a substitute item of equal or greater value.
We will not accept returns, replacement or exchange of items that are not faulty or damaged or which are not requiring size exchange.
Any items that are requested to be returned must be accompanied by their original packaging and any relevant original documentation specified by us and except in the case of faulty items, must remain unused and in original condition.

Disclaimer
You agree that your access to, and use of, this site is subject to these terms and all applicable laws, and is at your own risk. This site and its contents are provided to you on “as is” basis, the site may contain errors, faults and inaccuracies and may not be complete and current.

Little Black Box makes no representations or warranties of any kind, express, or implied, as to the operation of this site or the information, content, materials, or products included on this site, except as otherwise provided under applicable laws.

Neither Little Black Box, nor its affiliates, directors, officers, employees, agents, contractors, successors or assigns will be liable for any damages whatsoever arising out of, or in any way related to, the use of this site and any other site linked to this site. This limitation applies to direct, indirect, consequential, special, punitive or other damages you or others may suffer, as well as damages for loss of profits, business interruption or the loss of data or information.

Release and Indemnification/Liability Limitation
You agree to release Little Black Box and its staff, directors, officers, customers, representatives and agents (collectively, “Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the use of the site or any of the products or services sold by Little Black Box and to further indemnify, defend and hold harmless the Released Parties from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by you of any of these Terms and Conditions or any violation by you of applicable law.

In no event shall little black box, its parent company, subsidiaries, affiliates or any of their respective officers, directors, employees, agents, successors, subsidiaries, suppliers, affiliates, or third parties providing information on this site be liable to any user of the site or any other person or entity for any direct, indirect, special, incidental, punitive, consequential or exemplary damages (including, but not limited to, damages for loss of profits, loss of data, or loss of use) arising out of the use or inability to use the site, whether based upon warranty, contract, tort, or otherwise, even if little black box has been advised of or should have known of the possibility of such damages or losses. In no event shall the total liability of Little Black Box, its affiliates or any of their respective officers, directors, employees, agents, successors, subsidiaries, suppliers, affiliates or third parties providing information on this site to you for all damages, losses, and causes of action resulting from your use of this site, whether in contract, tort (including, but not limited to, negligence) or otherwise, exceed the amount you paid to Little Black Box in connection with the event giving rise to such liability.

Privacy
We use your information as described in the Little Black Box Privacy Policy. If you object to your information being transferred or used in this way then You may not use our services.

Trade Marks
This site includes registered trademarks, and other trademarks that are otherwise protected by law. Except as expressly authorised, the use of any of these trademarks is strictly prohibited.
